CW-1: CNMI-Only Transitional Worker Visa

H-2A Temporary Agricultural Workers

Update: June 16, 2021, marks the final date for USCIS to accept H-2A petitions with flexibilities under the temporary final rule. Changes made by this rule automatically cease on June 16. Subsequent H-2A petitions will adhere to the permanent provisions of the H-2A program.

Update: On Dec. 18, DHS issued a new temporary final rule extending the Aug. 20 rule. This extension temporarily allows H-2A petitioners with a valid temporary labor certification (TLC) to employ certain foreign workers already in the U.S. and in valid H-2A status. The rule also permits H-2A workers to change employers and commence work before USCIS approves the new H-2A petition. This extension applies to H-2A petitions for an extension of stay received on or after Dec. 18, 2020, through June 16, 2021.

L-1A Intracompany Transferee Executive or Manager

The L-1A nonimmigrant classification empowers a U.S. employer to transfer an executive or manager from its affiliated foreign offices to a U.S. office. This classification also facilitates a foreign company without a U.S. office to send an executive or manager to establish one. To initiate the process, the employer must submit a Form I-129, Petition for a Nonimmigrant Worker, with the requisite fee on behalf of the employee. The L-1 visa program facilitates these intracompany transfers, fostering collaboration and business development across borders.
